The Functional Home Training coaching program includes several modules including Fitness exercises, Yoga exercises, nutritional advice, healthy recipes, healthy daily habits and a community where like-minded individuals can find support in achieving their goals.

Functional Home Training takes all necessary measures to inform users and members about the terms of use of this website. The following terms of use are enforced for every user of the Functional home training website. The use of terms “we” and “our” refers to Functional Home Training, the coaches or professionals, affiliates, partners and all other subsidiaries under the umbrella of CFB Group bv (managing director of Functional Home Training), including any organization that will take over or merge into Functional Home Training in the future. The use of terms such as “our website”, “this website” or “site” refers to the Functionalhometraining.com website.

3. Limitation of Liability

Functional Home Training is not liable for:

You agree to indemnify, defend and hold harmless Functional Home Training, its partners, affiliates, officers, directors, employees, coaches, trainers, consultants and agents from all claims, liability, damages and / or costs of third parties ( including, but not limited to, attorneys and court fees) arising from your use of the Services, the Functionalhometraining.com website, your violation of the Terms of Use, or your violation, or violation by another user of your account, of any intellectual property or other right of an individual or entity. The terms of use benefit the successors, assigns and licensees of Functional Home Training.

4. Enforceability of Website Terms

If any provision of these Website Terms of Use is found in any way invalid or unenforceable by a court of competent jurisdiction, such provision will be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms of Use of the website and this with full force and effect. These terms of use are governed by and interpreted in accordance with the laws of the Belgian state.

The services offered by Functional Home Training are developed on the basis of our own knowledge and experience. These services, tips, recipes, exercises and recommendations in no way replace medical prescriptions or advice from a doctor, psychologist, diet or other expert.

If you have any doubts about the content, presentation, effect or consequences of the services and recommendations offered, you are completely free not to use or follow these services or recommendations. You are under no obligation to follow any recommendations, services, recipes or exercises if you are not convinced of the usefulness or consequences.

6. Trademark and Proprietary Rights

All design logos and the name of Functional Home Training displayed on the website functionalhometraining.com are the exclusive property of CFB group bvba, managing director of Functional Home Training. As such, CFB Group bvba owns all rights, titles and interests in the logos and name, including but not limited to copyright, trademark, service mark, trade dress, moral rights, rights under any legal protection of fine arts and otherwise, as applicable (hereinafter the “Intellectual Property”).

If an individual wishes to use Functional Home Training’s intellectual property for personal use, a direct request for consent must be submitted to Functional Home Training’s corporate office via our contact form.

Notwithstanding Functional Home Training’s ownership of the Intellectual Property, Functional Home Training hereby grants users of the functionalhometraining.com website previously approved for use a non-exclusive, non-commercial license to use the logos under the following terms and conditions . In addition to requiring permission for use, you must agree to these terms and conditions as a condition of using the license granted herein:

• The license to use the intellectual property is granted on an “as is” basis without warranty of any kind;
• The license is not exclusive;
• The license is for personal use only. The license does not confer any right to use the licensed intellectual property for commercial purposes of any kind;

• Functional Home Training reserves the right to withdraw the permission to use the intellectual property when it believes, in its sole discretion, that the privilege is being used in a way that is prejudicial to its interests or when it does not meet the requirements of the the above conditions are met.

7. Acceptance

By subscribing and creating an account you accept this agreement and agree to contract with us electronically.

We may update this agreement by posting a revised version on our website. Functional Home Training encourages users to review these terms of use each time you visit the Functionalhometraining.com website. By continuing to use our services, you accept any revised agreement.

8. Our services

• Services: The services and features available to you depend on your subscription plan. We may change the services and features from time to time. If you have a paid account, we commit to providing the main modules of your subscription that are listed at the time of purchase during your current service period.
• Downloadable Software: We may provide applications for devices (“apps”) directly or through third party stores. Subject to your compliance with these Terms of Service, Functional Home Training grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps. We may update apps from time to time to add new features and / or fix bugs. Make sure you are using the most recent version of the app that is compatible with your device. We cannot guarantee that you will be able to use the most recent version of the app on your device.
• Third Parties: We may provide links to and integrations with websites or services operated by others. Your use of any of these websites or services is subject to the terms of service of those third parties.

9. Accounts

• Registration: you can create an account to use certain functions we offer (for example, watching videos or consulting articles and recipes). You must provide at least one e-mail address for this. By creating an account, you agree to receive notifications from Functional Home Training at this email address.
• Parents, Guardians: By authorizing your child to use our services through your account, you agree and understand that you are responsible for supervising your child’s use. If you believe your child is using your account and does not have permission, please contact us immediately so we can disable access.
• Account Security: You are responsible for all activities that occur under your account, including unauthorized activities. You must maintain the confidentiality of your account information. If you are using a computer or mobile device that others can access, you must log out of your account after each session. If you become aware of unauthorized access to your account, you must change your password and notify us immediately.

10. Subscription Plans

• Types of Subscriptions: We offer several paid subscription plans that allow you to watch video and other content. You can buy an “Individual” plan where you subscribe yourself and pay online. Companies, groups, organizations or clubs can subscribe to a “Business Package” plan for their members. Any discounts enjoyed by members of a “Business Package” are discussed in advance with a Functional Home Training sales representative and form part of a “Business Package” agreement. Advertised prices and features are subject to change.
• Fees: You must pay all fees (plus any taxes) during your subscription period and any renewal periods. Our fees may include a fixed monthly, quarterly, semi-annual or annual amount plus variable fees for specific transactions, uses or promotions.
• Discounts and Free Trials: We can offer free trials or discounted subscriptions. When a free trial ends, your paid subscription period automatically starts (unless you canceled it) and you have to pay the full monthly, quarterly, semi-annual or annual amount. If we give a discount for the first subscription period, you will pay the appropriate discounted rate and you will be required to pay the full fee for each renewal.
• Refund Policy: In case an individual member wishes to terminate his / her subscription, he / she can do so by canceling the subscription plan in his / her personal account page. This termination must occur before the first of the last month of the subscription period, whereby a subscription can only expire at the end of the month. Subscription fees already paid (for any subscription plan or period) will not be refunded.
• Automatic Renewal: To the extent permitted by applicable law, subscriptions automatically renew at the end of each subscription period unless canceled in advance. Monthly, quarterly, half-yearly subscriptions are renewed for periods of 1, 3 or 6 month (s) respectively. Annual plans are extended for periods of one year. You must pay the monthly, quarterly, semi-annual, or annual fee (plus any taxes) when each renewal period begins.
• Deny Renewal: Individual subscribers can opt out of auto-renewal by changing their account settings. Customers who benefit from a “Business Package” subscription can unsubscribe from Functional Home Training services and the termination of payments will be arranged according to the arrangements made and recorded in the “Business Package” agreement. Any opt-out or notice of non-renewal will not affect the current subscription period. Functional Home Training can refuse extensions.
• Expiration Policy: When a subscription expires, the account will revert to its Basic (free) account status or be deleted at the option of Functional Home Training. All contents of the account can be removed to comply with the restrictions of the new account status. You are responsible for modifying or removing your personal information. We may publish additional guidance on how to handle expired subscriptions. These guidelines only describe current practices and do not require Functional Home Training to provide any level of account status after enrollment.
• In-App Purchase: We may allow you to purchase subscriptions within Apps. When you make such “in-app” purchases, you will be billed by the app platform, not by us. To turn off auto-renewal for subscriptions, go to your platform’s account settings (not Functional Home Training’s). Our refund policy does not apply to in-app purchases. Billing inquiries should be directed to the app platform.
• Resale: You may not sell, resell, rent, lease or distribute a subscription plan or any other aspect of our services to any third party unless authorized by us in writing.

11. Acceptable Use Policy

We may allow you to upload, live stream, submit or publish content such as videos, recordings, images and text (articles, white papers, comments, testimonials, etc.). You must ensure that your content and behavior comply with the Acceptable Use Policy, including language and use of unethical imagery. Functional Home Training may (but is not required to) monitor your account, content and behavior regardless of your privacy settings. Functional Home Training may remove or restrict access to or availability to any content or accounts that it has a good faith belief violates this Acceptable Use Policy.

12. Copyright Policy

You may only upload or share content that you are allowed to upload and share. Copyright owners can send Functional Home Training a takedown notice if they believe Functional Home Training is using infringing material. We will, in appropriate circumstances, terminate the accounts of repeat infringers.

13. Content Restrictions

You may not submit or share content that:

• Violates the copyrights or other rights of any third party (eg, trademark, privacy rights, etc.);
• Is sexually explicit or promotes a sexual service;
• Contains a political, religious or racial message;
• Is defamatory;
• Is intimidating or offensive;
• Contains hateful or discriminatory language;
• Contains false or misleading claims about health-related information that has the potential to cause serious harm to the public;
• Violates any applicable law.

14. Code of Conduct

When using our services it is not allowed to:

• Using an objectionable screen name or avatar;
• Acting in a deceptive manner or impersonating a person or organization;
• Harass or stalk someone;
• Spread spam in any form or use misleading metadata;
• Collect personal information about others;
• Access another person’s account without permission;
• Engage in illegal activities;
• Download, embed or link our videos, recipes, articles and other assets to other sites; or
• Encourage others to do the above.

15. Prohibited technical measures

You are not allowed to:

• Except as permitted by law or as permitted by us: reproduce, redistribute, create derivative works, decompile, reverse engineer, modify, archive, or convert any part of our services Circumvent our security or digital rights management measures;
• Adding a malicious program, script or code; or
• Take other actions to manipulate, disrupt or damage our services.

16. Other Content and Feedback

With any content (for example, comments or comments on articles or videos or testimonials or results) that you publicly share on the website or any of Functional Home Training’s social channels, you grant Functional Home Training a perpetual and irrevocable right and license to use such content. copy, transmit, distribute, disclose and display through online means in connection with our services. If you make suggestions to Functional Home Training to improve our products or services, Functional Home Training may use your suggestions without any compensation to you.

17. Disclaimer

You indemnify Functional Home Training and its parent and subsidiaries, parents and affiliates, and their respective directors, officers, employees and agents, from and against all complaints, demands, claims, damages, third party losses, costs, liabilities and expenses, including attorney and judicial costs arising from or related to the content that we make available.

18. Term and Termination

This Agreement begins when you first use our services and continues for as long as you use our services or have an account with us, whichever is longer. Paid accounts will continue throughout the subscription period and will be renewed in accordance with the Renewals section. With users who do not have a subscription (ie free users), Functional Home Training has no commitment or obligation.

If you breach this Agreement, Functional Home Training may, at its option: (a) terminate this Agreement immediately, with or without prior written notice; (b) suspend, delete or restrict access to your account or any content therein; and (c) to the extent permitted by applicable law, withhold all amounts due to you. If Functional Home Training deletes your account for infringement, you may not register again.

19. Disclaimers

Functional Home Training provides the services on an “as-is” and “as-is available” basis. You use the services on a voluntary basis and at your own risk.

Except as expressly provided herein, and to the extent permitted by applicable law, Functional Home Training disclaims all express or implied warranties. Functional Home Training makes no representations or guarantees, among other things:

• That our services, or any part thereof, are available or permitted in your jurisdiction, uninterrupted or error-free, completely secure, or accessible from any device or browser;
• That we will host, make available or remove a specific piece of content;
• In relation to any content submitted by or actions of our users;
• That any geofiltering or digital rights management solution we offer will be effective;
• That we comply with industry-specific privacy obligations;
• That our services will meet your business or professional needs;
• That we continue to support a particular feature or maintain backward compatibility with third party software or devices; or
• With regard to websites and resources of third parties.

20. Limitation of Liability

Functional Home Training is not liable for any direct, indirect, incidental, special or specific damage or consequences for physical, mental and mental health, even if Functional Home Training is aware of the possibility of such damage.

21. Disputes, Arbitration and Choice of Law

If for any reason you are dissatisfied with our services, please contact us first so we can try to resolve your issues without outside help.

• Choice of Law: All disputes relating to this agreement or your use of our services will be governed by the laws of the Belgian State (relating to matters under federal jurisdiction, such as copyright), without regard to conflict of law principles .
• Relationship: you and Functional Home Training are independent contractors of each other; neither party is an agent, partner or joint venturer of the other party. You may not transfer this Agreement to any person whose account has been terminated by Functional Home Training or who is prohibited from registering; such transfer is null and void. Except as expressly stated herein, nothing in this Agreement confers any rights on any third party.

The Dutch version of this agreement takes precedence. For convenience, we may provide translated versions of this Agreement.
